NOC for sale or transfer of a flat

A format for a society to give a No Objection Certificate when a member sells or transfers a flat.

Fill in the details
Leave blank space at the top if you print on pre-printed letterhead paper. Society name and address are then left out.
Things to check before you send it
  • Confirm there are no pending maintenance dues, penalties or legal disputes against the flat.
  • Check whether your bye-laws or the committee's resolution require a transfer fee or premium, and mention it separately.
  • Keep a signed copy in the member's file.
Frequently asked questions
Is a society NOC mandatory for selling a flat?

Most societies require the seller to inform the committee and obtain its consent or NOC before the transfer is registered. Your bye-laws and local rules decide the exact process, so check them or ask a lawyer.

Can the society refuse to give a NOC?

A society should only withhold a NOC for reasons its bye-laws and the law allow, such as unpaid dues. If you are unsure, take legal advice.
