Which laws usually apply and how to find the current official text.

Laws that commonly apply

The exact set depends on your state and how your society is registered. In Maharashtra, societies commonly deal with the following:

  • The Maharashtra Co-operative Societies Act, 1960, and the Rules made under it.
  • The model bye-laws for co-operative housing societies, and your society's own registered bye-laws.
  • The Maharashtra Ownership Flats Act, 1963 (relevant to builders and flat purchasers).
  • The Real Estate (Regulation and Development) Act, 2016 and the state rules made under it.

How to get the current text

Laws are amended often. Always read the latest official version rather than a copy from the internet or an old booklet. Official copies are published by the state government and the state legislature, and by the Cooperation Department for co-operative society matters. Your society's registered bye-laws are in the society office and with the registrar.
